Please be informed that the Santos Port Authority (APS) has approved an agreement with Centronave (Centro Nacional de Navegação Transatlântica) to settle the legal dispute regarding the Waterway Access Infrastructure Tariff – Table I at Santos Port.
The agreement, announced by APS on September 24, 2026, provides for the tariff reclassification of Centronave members under Table I, as well as the consolidation of criteria for tariff discounts based on navigation frequency and type of operation.
The main points are as follows:
- Approximately BRL 416.9 million in amounts currently deposited in court are expected to be released to APS following judicial approval of the agreement and completion of the applicable procedures.
- Once the agreement is approved, new tariff payments will be made directly to APS, instead of through judicial deposits.
- The tariff discounts will be based on objective criteria related to navigation frequency and type of navigation, and will apply equally to all users meeting the relevant requirements, regardless of Centronave membership.
- APS will also carry out the necessary review and reconciliation of amounts previously invoiced and deposited in court.
- The agreement is subject to approval by the 4th Federal Court of Santos/SP, under case No. 5000363-29.2022.4.03.6104.
It is also important to note that APS has already established specific tariff discount mechanisms for Table I – Waterway Access Infrastructure. The latest regulations include DIPRE Portarias No. 103/2026 and 104/2026, which establish discounts based on navigation frequency/type and for vessels registered under the Environmental Ship Index (ESI) with a positive score, respectively.
Therefore, the new agreement should be understood as a settlement of the historical tariff dispute and as a framework for the treatment of the amounts deposited in court, while the applicable discounts continue to be governed by the respective APS regulations.
